• Minnesota is using the 10th Amendment to sue Homeland Security to remove the ICE and Border Patrol agents.

10th Amendment – The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

• To borrow money on the credit of the United States.
• To make regular, what does that mean? To make regular. 
• To establish a uniform rule of naturalization and uniform rules of bankruptcy. 
• So what did we learn today?
• Can the states determine who is an alien friend vs alien enemy?
• Your natural born citizenship clause would mean NOTHING if EACH state could determine what a natural born citizen is.

• If your state ratified the Constitution, then your state handed over that power to the Federal government. 
• Interestingly enough, Madison and Jefferson made the argument that the states DID have the right.

• But here is the distinction: Alien Friend v Alien Enemy
• Friend as determine by municipal law – Alien Friend – Example Tulane University decides to hold a International Rugby Tournament. Who is allowed to play? LSU submits a team, Southeastern submits a team, Tulane submits a team, Texas A&M submits a team and Georgia submits a team. The Republic of Ireland wishes also to send a Rugby team to this tournament. So the Irish and schools from other surrounding states all come to New Orleans for this tournament. How does this Irish team get here? They fly and land in NOLA airport. They go through customs and declare everything and what is their purpose. Everyone still with me so far? The State of Louisiana welcomes you as an alien FRIEND. You can travel anywhere in the state of Louisiana as long as you don’t break any laws. We don’t make them citizens, and ultimately they have to leave right? 
• THAT is the argument Madison was making at the time, he was referring to French people VISITING. 
• There is another clause in the Constitution called the Slave Clause, that says from the day of ratification, there will be an end to the slave trade. That is also an immigration clause. 
• After 1808 that basically didn’t happen, they weren’t being brought here for that.

• It didn’t say the state of Louisiana could protect these Irish against the Federal government. 
• FLIP THIS ARGUMENT – 
• Let’s say Louisiana says no and stops this Irish rugby team at the airport. What if we say..…you know we don’t really like the Irish so you are an Alien Enemy. Here is the rub….Jefferson and Madison didn’t argue whether or not the STATE could declare an Alien Enemy only the Federal government could. They only argued about Alien Friends.

• The Democrats are going down swinging!
• I know a little about human nature, some lower level stooge who has nothing, they will make deals. 
• Hillary Clinton can’t kill them all.
• They stick together because they are bound by fear not values. One problem for Tim Walz in particular, he didn’t have much protection or friends.
• The Democrats from Minnesota have played this game for years and we must get to the bottom of this to prevent it from spreading to other states.

• How do you square our case log all of whom involve a subclass of people that challenge on equal protection grounds?
• The state interest is the safety of women right? 

• There is no science that says a man can become a woman.
• We are still tied up on some issues, there has been no evolution on this topic either. 
• The EU understands you can’t have chemicals in food and men in women’s sports so why are WE still debating this?
• We are just stuck in a cycle of ideology not reality.

• Trump relied on Rubio heavily to navigate Latin America in his first term.
